Terms of Service

These Terms form a binding agreement between you (“you,” “your,” or “user”) and Clesial (“Clesial,” “we,” “us,” or “our”). They apply to all visitors and registered users. Additional terms may apply to specific features (for example, pricing shown at checkout); if those conflict with these Terms for a paid purchase, the checkout terms control for that purchase to the extent permitted by law.

Clesial is an independent exam-preparation platform focused on NCLEX-RN readiness. The Service may include diagnostics, practice questions, explanations, mistake review, study notes, analytics, readiness tools, and related educational features. The Service is a study aid for educational use only.

Clesial is not medical advice, not a substitute for professional nursing education or clinical judgment, and is not affiliated with or endorsed by NCSBN. NCLEX® and NCLEX-RN® are registered trademarks of their respective owner. Our questions are original, NCLEX-style practice items — not actual exam questions — and are prepared for study purposes and reviewed for quality before publication.

You must be at least 18 years old (or the age of majority where you live) to use Clesial.

• Provide accurate account information and keep it up to date.
• You are responsible for activity under your account and for keeping your credentials secure.
• One account per person; accounts may not be shared, sold, or transferred.
• Notify us promptly at the contact below if you suspect unauthorized access to your account.

We may offer free or limited (“Starter”) access and paid plans with additional features. Feature availability, question pools, tests, and limits are described on the Service (including the pricing page) and may differ between free and paid access. We may change free-tier features, limits, or availability from time to time; material changes will be reflected on the Service.

Paid access is granted for the plan duration and features shown at checkout after payment is successfully verified. Unless checkout clearly states otherwise, current plans are fixed-duration access for the purchased period.

Paid plans are displayed and charged in Indian rupees (INR) unless we expressly show another currency. The checkout page shows the applicable price and plan duration before you pay. Payments are processed by Razorpay under Razorpay’s terms and privacy policy; Clesial does not store your full card, UPI, bank, wallet, or other payment credentials. Access is activated only after server-side payment verification. Your bank or payment provider may impose separate charges.

Current plans are fixed-duration, non-renewing access unless checkout clearly says otherwise, so there is no recurring subscription to cancel. You may stop using Clesial or delete your account at any time; deleting an account does not itself create a refund.

If you were charged more than once, paid but did not receive access, or believe a payment was unauthorized, contact support@clesial.com promptly with your Razorpay payment ID. Approved refunds are returned to the original payment method through Razorpay. Bank processing times vary. Except where required by applicable law or expressly stated at checkout, fees for access already activated are non-refundable. Nothing in these Terms limits non-waivable consumer rights.

When using the Service, you agree not to:

• Copy, scrape, download in bulk, redistribute, resell, publicly post, or commercially exploit our questions, rationales, explanations, notes, analytics, or other content.
• Share login credentials, allow others to use your account, or use another person’s account.
• Use the Service to operate a cheating, answer-sharing, or exam-compromise service, or to misrepresent practice content as official exam material.
• Reverse engineer, disrupt, overload, probe, or attempt to gain unauthorized access to the Service, our systems, or other users’ data.
• Bypass paywalls, access controls, rate limits, or other technical protections.
• Upload malware, spam, or harmful content, or harass other users or our staff.
• Use the Service for any unlawful purpose or in violation of these Terms.

All questions, rationales, explanations, study materials, analytics, software, branding, and other platform materials are owned by Clesial or its licensors and are protected by applicable intellectual property laws. Except for the limited license below, no rights are granted by implication or otherwise.

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service and its content solely for your own exam preparation. You may not copy, modify, create derivative works from, distribute, publicly display, or commercially use our content except as expressly allowed by these Terms or by written permission from us.

To operate the Service we process study activity such as answers, session progress, bookmarks, and similar records. How we collect and use personal information is described in our Privacy Policy, which is incorporated by reference. You are responsible for the accuracy of information you provide.

Clesial helps you practice, review, and track readiness, but exam outcomes depend on many factors outside our control. Readiness scores, diagnostics, and similar indicators are study tools, not official predictions or certifications, and we do not guarantee that you will pass any exam or achieve any particular score or credential.

We aim to keep the Service available and useful, but we do not guarantee uninterrupted, error-free, or continuous access. We may modify, suspend, or discontinue features, content, or the Service (in whole or in part) with or without notice, including for maintenance, security, legal, or product reasons. We are not liable for downtime or feature changes to the extent permitted by law.

The Service may rely on third parties such as payment processors (including Razorpay), authentication, email, hosting, analytics, or similar providers. Their services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control, except as required by applicable law.

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that content is complete, current, or free of errors.

To the maximum extent permitted by law, Clesial and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or exam results, arising from or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid to Clesial for the Service in the three months before the claim, or (b) INR 2,000. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

To the extent permitted by law, you agree to indemnify and hold harmless Clesial and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any third-party right, except to the extent caused by our own willful misconduct or as otherwise prohibited by law.

You may stop using Clesial and permanently delete your account and study data from Student Settings at any time. We may suspend or terminate access that violates these Terms or that we reasonably believe is harmful to other users, our rights, or the Service. Upon termination, your license to use the Service ends. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive. Legally required payment and transaction records may be retained after account deletion.

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Where required by law, we may provide additional notice. Your continued use of the Service after changes become effective means you accept the updated Terms. If you do not agree, you must stop using the Service.

These Terms are governed by the applicable laws of India, without limiting mandatory consumer protections that apply where you live. Courts in India will have jurisdiction over disputes arising from these Terms, subject to any non-waivable rights you may have to bring claims in your local courts or forums.

• If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
• These Terms, together with the Privacy Policy and any checkout terms for a specific purchase, are the entire agreement between you and Clesial regarding the Service and supersede prior conflicting understandings on the same subject.
• Our failure to enforce a provision is not a waiver of our right to enforce it later.
• You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Headings are for convenience only and do not affect interpretation.
